A Guatemalan national has been indicted on charges of unlawful reentry into the United States, as announced by Acting U.S. Attorney Jay McCormack. Jorge Misael Niz, 42, was previously deported to Guatemala on March 30, 2006. He was found in Salem on April 27, 2025, and is currently in Immigration and Customs Enforcement custody. Niz is scheduled to appear in federal court at a later date.

The statute under which Niz is charged allows for a sentence of up to two years in prison, one year of supervised release, and a fine of up to $250,000. Sentences are determined by a federal district court judge based on the U.S. Sentencing Guidelines and relevant statutes.

The investigation was led by Immigration and Customs Enforcement, with Assistant U.S. Attorney Matthew Vicinanzo prosecuting the case.

This indictment is part of Operation Take Back America, an initiative that utilizes the Department of Justice’s resources to combat illegal immigration and transnational criminal organizations while protecting communities from violent crime. The operation coordinates efforts with the Department’s Organized Crime Drug Enforcement Task Forces (OCDETFs) and Project Safe Neighborhood (PSN).

It should be noted that the details in the charging documents are allegations, and Niz is presumed innocent until proven guilty beyond a reasonable doubt in court.
